Terms and Conditions

These terms govern every video editing, content strategy and related service provided by Voxen Visuals ("Voxen", "we", "us"). You ("the client", "you") accept them when we agree to work together: by approving a proposal, confirming an order or making the agreed payment. Please read them before that moment.

01Services

Voxen is a content and marketing studio. Depending on what you contract, our services include content strategy and planning, scriptwriting, filmmaking and production, video editing (short and long form: reels, shorts, VSL, podcasts, YouTube, vlogs, talking head, gaming and AI-assisted pieces), motion graphics, community management, paid advertising, publishing and performance reporting through our own platform, and any combination of these as an integral marketing service.

The exact scope of each project (formats, number of pieces, duration, style, deadlines and price) is defined in the proposal or order you approve. Anything not written in the proposal is not included. Source or project files (for example Premiere Pro, After Effects, DaVinci Resolve or any other editing software projects) are not part of a delivery unless the proposal says so.

02Quotes, orders and bundles

Every project starts with a proposal that states scope, timeline, price and payment plan. The project is confirmed when you approve the proposal and make the agreed payment.

Validity and expiry. Proposals and their prices are valid for 15 days. Once you approve a proposal, the agreed payment must be received within 7 days; after that the proposal expires and a new one may be issued at current prices. Once paid, a project must start (material and brief received) within 30 days; if it does not, it is rescheduled subject to our availability. Paid orders or bundle pieces that have not been used within 90 days of payment expire and are not refundable.

Bundles and monthly plans. Bundle and monthly pricing is lower than the price of individual pieces because it is sold as a package. For that reason a bundle counts as started as soon as work begins on its first video, and from that moment the whole bundle is subject to the cancellation rules in section 06.

03Payment

Prices, currency and payment methods are stated in each proposal. Depending on the project, payment can be:

• Full payment upfront, before work starts.
• 50 / 50: a deposit before work starts and the balance on completion. With this plan the first half of the pieces is produced after the deposit and the rest after the balance is received.
• Post delivery, only when expressly agreed in the proposal.

Prices do not include taxes, duties or withholdings that may apply in your country, which are your responsibility. Invoices or receipts are issued for every order. Any bank, platform or currency conversion fees are borne by the client.

04Your material and responsibilities

You are responsible for the material you send us (footage, audio, images, music, logos, fonts, scripts and any other asset). By uploading it you confirm that:

• You own it or have the rights and licences needed for us to edit it and for you to publish the result, including music, stock assets and third-party content.
• Anyone who appears in the material has given the consent required for it to be used.
• It does not infringe any law or third-party right and does not contain illegal content.

You are also responsible for sending the material in the agreed quality and for providing briefs, feedback and approvals in reasonable time. Delays on your side move the delivery date accordingly.

If a third party claims that material you provided infringes their rights, you will hold Voxen harmless from that claim.

05Delivery and revisions

Standard turnaround is usually between 2 and 4 business days per piece, depending on the project. The concrete deadline is agreed before we start and is shown for each piece in your client portal. Deadlines count from the moment we have all the material and information needed. Deliveries requested faster than the agreed turnaround are quoted separately as rush work and depend on our availability.

Revisions. Revisions are unlimited and are organised in two rounds per piece: you gather all the changes for a round and send them together through the platform (comments can be left on the exact second of the video). We keep adjusting until you are satisfied within the scope of the original brief. Changes that alter the scope (new footage, a different concept, a longer piece, additional formats) are quoted separately.

A piece is considered approved when you approve it in the platform or when 14 days pass after a delivery or revision without feedback from you.

06Cancellations and refunds

Because our work starts as soon as an order is confirmed, payments are non-refundable once work has begun. This includes deposits.

For bundles and monthly plans, the whole bundle is considered started when work begins on its first video, and no refund applies to the remaining pieces. If you prefer to stop, the pieces already delivered stay yours and the remaining ones can be scheduled at a later date, subject to agreement.

If we are unable to deliver a project for reasons attributable to us, we will refund the part of the payment that corresponds to the work not delivered.

07Late payment

If a payment that is due is not received, we may withhold final deliveries, pause the project and the publishing services until the balance is settled. Work resumes once payment is received, with the deadlines adjusted accordingly. Delivered previews and watermarked or low-resolution versions may not be published until the balance is paid.

08Intellectual property

Your content. You keep all rights over the material you provide.

Final videos. Once a project is fully paid, the final delivered videos belong to you and you can use them without restriction on any platform. Until full payment, they remain the property of Voxen.

Portfolio. We may show the videos we produce for you on our website, social media and presentations as examples of our work, unless you tell us in writing that you prefer we don't, or a contract or non-disclosure agreement between us says otherwise. We never share unpublished material before you publish it. We may also mention you as a client (your name, brand, logo or public social handle) and quote feedback you give us, on our website and in our presentations, unless you tell us in writing that you prefer we don't.

Our tools and know-how. Our workflows, templates, presets, platform and internal methods remain ours. Third-party assets (music, stock footage, fonts, plug-ins) are subject to their own licences, which we will tell you about when relevant.

09File retention

Raw material, working files and deliveries are kept on our platform for 14 days after each delivery. Every time a revision is sent, the 14-day period starts again from that moment. After that period the files may be deleted, so please download your final videos when they are approved. If you need us to keep files for longer, ask us before the period ends.

10Client platform and accounts

We give you access to our client platform so you can follow the status of each piece, leave comments on the exact second of a video, approve deliveries, download files, manage your orders, proposals, payments and invoices, keep your brand guidelines, use your content calendar and, when contracted, manage publishing and metrics of your connected social accounts. Accounts are created by us and are personal: keep your credentials safe, do not share them and let us know if you suspect unauthorised access. You can sign in with Google or with email and password, and enable two-step verification. Your sign-in data is private and is used only to give you access.

You agree to use the platform only for the projects we work on together and not to attempt to access other clients' data, disrupt the service or upload malicious content. We may suspend access in case of misuse.

The platform is provided "as is". We work to keep it available but do not guarantee uninterrupted access, and it does not replace your own backups of your content.

11Use of AI tools

We use artificial intelligence tools in parts of our process, for example to analyse briefs, draft texts, transcribe audio, suggest cuts or generate visual elements. Every piece is reviewed and finished by our team before it is delivered. If a project requires that no AI-generated elements be used, tell us in the brief and we will work accordingly. AI-generated content is delivered under the same conditions as the rest of the work, subject to the limitations of the tools used and applicable law.

12Confidentiality

We treat your unpublished material, briefs, business information and access data as confidential and use them only to provide the service. We may involve members of our team and trusted collaborators in your project; all of them, and our service providers, are bound to the same confidentiality. See our Privacy Policy for how we handle personal data.

13Warranties and liability

We commit to deliver work of professional quality that matches the approved brief. We do not guarantee any specific result on social platforms (views, reach, followers, sales), since that depends on factors outside our control.

To the extent permitted by law, our total liability for any claim related to a project is limited to the amount you paid for that project. We are not liable for indirect damages, loss of profit or loss of data, nor for problems caused by material provided by you, by third-party platforms or by events beyond our reasonable control.

14Changes to these terms

We may update these terms from time to time. The version published on this page at the time you confirm a project is the one that applies to it. Significant changes will be communicated to active clients through the platform or by email.

Estos términos rigen todos los servicios de edición de video, estrategia de contenido y servicios relacionados que presta Voxen Visuals ("Voxen", "nosotros"). Tú ("el cliente") los aceptas cuando acordamos trabajar juntos: al aprobar una propuesta, confirmar un pedido o realizar el pago acordado. Léelos antes de ese momento.

01Servicios

Voxen es un estudio de contenido y marketing. Según lo que contrates, nuestros servicios incluyen estrategia y planificación de contenido, guiones, filmación y producción, edición de video (formato corto y largo: reels, shorts, VSL, podcasts, YouTube, vlogs, talking head, gaming y piezas asistidas por IA), motion graphics, community management, publicidad paga, publicación y reportes de rendimiento a través de nuestra propia plataforma, y cualquier combinación de estos como servicio integral de marketing.

El alcance exacto de cada proyecto (formatos, cantidad de piezas, duración, estilo, plazos y precio) se define en la propuesta o pedido que apruebas. Lo que no está escrito en la propuesta no está incluido. Los archivos fuente o de proyecto (por ejemplo proyectos de Premiere Pro, After Effects, DaVinci Resolve o cualquier otro programa de edición) no forman parte de la entrega salvo que la propuesta lo indique.

02Propuestas, pedidos y paquetes

Todo proyecto empieza con una propuesta que indica alcance, plazos, precio y plan de pago. El proyecto queda confirmado cuando apruebas la propuesta y realizas el pago acordado.

Vigencia y vencimiento. Las propuestas y sus precios tienen una vigencia de 15 días. Una vez aprobada la propuesta, el pago acordado debe recibirse dentro de los 7 días; pasado ese plazo la propuesta vence y puede emitirse una nueva a los precios vigentes. Una vez pagado, el proyecto debe comenzar (material y brief recibidos) dentro de los 30 días; si no, se reprograma según nuestra disponibilidad. Los pedidos pagados o las piezas de un paquete que no se hayan utilizado dentro de los 90 días desde el pago vencen y no son reembolsables.

Paquetes y planes mensuales. El precio de los paquetes y planes mensuales es menor que el de las piezas individuales porque se vende como conjunto. Por eso un paquete se considera iniciado en cuanto comienza el trabajo en su primer video y, desde ese momento, todo el paquete queda sujeto a las reglas de cancelación de la sección 06.

03Pago

Los precios, la moneda y los medios de pago se indican en cada propuesta. Según el proyecto, el pago puede ser:

• Pago total por adelantado, antes de empezar el trabajo.
• 50 / 50: una seña antes de empezar y el saldo al finalizar. Con este plan, la primera mitad de las piezas se produce tras la seña y el resto una vez recibido el saldo.
• Post entrega, solo cuando se acuerda expresamente en la propuesta.

Los precios no incluyen impuestos, aranceles ni retenciones que puedan aplicar en tu país, que corren por tu cuenta. Se emite factura o recibo por cada pedido. Las comisiones bancarias, de plataforma o de conversión de moneda corren por cuenta del cliente.

04Tu material y responsabilidades

Eres responsable del material que nos envías (grabaciones, audio, imágenes, música, logos, tipografías, guiones y cualquier otro recurso). Al subirlo confirmas que:

• Es tuyo o cuentas con los derechos y licencias necesarios para que lo editemos y para que publiques el resultado, incluidos música, recursos de stock y contenido de terceros.
• Toda persona que aparece en el material dio el consentimiento necesario para su uso.
• No infringe ninguna ley ni derecho de terceros y no contiene contenido ilegal.

También eres responsable de enviar el material con la calidad acordada y de dar briefs, comentarios y aprobaciones en un tiempo razonable. Las demoras de tu lado desplazan la fecha de entrega en la misma medida.

Si un tercero reclama que el material que nos diste infringe sus derechos, mantendrás a Voxen indemne frente a ese reclamo.

05Entrega y revisiones

El plazo estándar de entrega suele ser de 2 a 4 días hábiles por pieza, según el proyecto. La fecha concreta se acuerda antes de empezar y se muestra para cada pieza en tu portal de cliente. Los plazos cuentan desde que tenemos todo el material y la información necesarios. Las entregas más rápidas que el plazo acordado se cotizan aparte como trabajo urgente y dependen de nuestra disponibilidad.

Revisiones. Las revisiones son ilimitadas y se organizan en dos rondas por pieza: reúnes todos los cambios de una ronda y los envías juntos a través de la plataforma (los comentarios pueden dejarse en el segundo exacto del video). Seguimos ajustando hasta que quedes conforme dentro del alcance del brief original. Los cambios que alteran el alcance (material nuevo, otro concepto, una pieza más larga, formatos adicionales) se cotizan aparte.

Una pieza se considera aprobada cuando la apruebas en la plataforma o cuando pasan 14 días desde una entrega o revisión sin comentarios de tu parte.

06Cancelaciones y reembolsos

Como nuestro trabajo empieza en cuanto se confirma un pedido, los pagos no son reembolsables una vez iniciado el trabajo. Esto incluye las señas.

En paquetes y planes mensuales, todo el paquete se considera iniciado cuando comienza el trabajo en su primer video, y no corresponde reembolso por las piezas restantes. Si prefieres parar, las piezas ya entregadas son tuyas y las restantes pueden programarse para más adelante, previo acuerdo.

Si no podemos entregar un proyecto por causas atribuibles a nosotros, reembolsaremos la parte del pago que corresponda al trabajo no entregado.

07Pagos atrasados

Si no se recibe un pago vencido, podemos retener las entregas finales y pausar el proyecto y los servicios de publicación hasta que se salde el pendiente. El trabajo se retoma al recibir el pago, con los plazos ajustados en consecuencia. Las previsualizaciones entregadas y las versiones con marca de agua o en baja resolución no pueden publicarse hasta que se pague el saldo.

08Propiedad intelectual

Tu contenido. Conservas todos los derechos sobre el material que nos das.

Videos finales. Una vez pagado el proyecto por completo, los videos finales entregados son tuyos y puedes usarlos sin restricciones en cualquier plataforma. Hasta el pago total, siguen siendo propiedad de Voxen.

Portfolio. Podemos mostrar los videos que producimos para ti en nuestro sitio web, redes sociales y presentaciones como ejemplos de nuestro trabajo, salvo que nos indiques por escrito que prefieres que no lo hagamos, o que un contrato o acuerdo de confidencialidad entre nosotros diga lo contrario. Nunca compartimos material inédito antes de que lo publiques. También podemos mencionarte como cliente (tu nombre, marca, logo o usuario público en redes) y citar los comentarios que nos des, en nuestro sitio web y en nuestras presentaciones, salvo que nos indiques por escrito que prefieres que no.

Nuestras herramientas y know-how. Nuestros flujos de trabajo, plantillas, presets, plataforma y métodos internos siguen siendo nuestros. Los recursos de terceros (música, stock, tipografías, plugins) están sujetos a sus propias licencias, que te informaremos cuando sea relevante.

09Conservación de archivos

El material en bruto, los archivos de trabajo y las entregas se conservan en nuestra plataforma durante 14 días después de cada entrega. Cada vez que se envía una revisión, el plazo de 14 días vuelve a contar desde ese momento. Pasado ese plazo los archivos pueden eliminarse, así que descarga tus videos finales cuando los apruebes. Si necesitas que conservemos archivos por más tiempo, pídelo antes de que venza el plazo.

10Plataforma de clientes y cuentas

Te damos acceso a nuestra plataforma de clientes para que sigas el estado de cada pieza, dejes comentarios en el segundo exacto de un video, apruebes entregas, descargues archivos, gestiones tus pedidos, propuestas, pagos y facturas, guardes tu manual de marca, uses tu calendario de contenido y, cuando lo contrates, gestiones la publicación y las métricas de tus redes conectadas. Las cuentas las creamos nosotros y son personales: cuida tus credenciales, no las compartas y avísanos si sospechas un acceso no autorizado. Puedes iniciar sesión con Google o con email y contraseña, y activar la verificación en dos pasos. Tus datos de acceso son privados y se usan solo para darte acceso.

Te comprometes a usar la plataforma solo para los proyectos que hacemos juntos y a no intentar acceder a datos de otros clientes, interrumpir el servicio ni subir contenido malicioso. Podemos suspender el acceso en caso de mal uso.

La plataforma se ofrece "tal cual". Trabajamos para mantenerla disponible, pero no garantizamos un acceso ininterrumpido, y no reemplaza tus propias copias de seguridad de tu contenido.

11Uso de herramientas de IA

Usamos herramientas de inteligencia artificial en partes de nuestro proceso, por ejemplo para analizar briefs, redactar textos, transcribir audio, sugerir cortes o generar elementos visuales. Cada pieza es revisada y terminada por nuestro equipo antes de entregarse. Si un proyecto requiere que no se usen elementos generados por IA, indícalo en el brief y trabajaremos en consecuencia. El contenido generado con IA se entrega en las mismas condiciones que el resto del trabajo, sujeto a las limitaciones de las herramientas utilizadas y a la ley aplicable.

12Confidencialidad

Tratamos tu material inédito, briefs, información de negocio y datos de acceso como confidenciales y los usamos solo para prestar el servicio. Podemos involucrar a miembros de nuestro equipo y colaboradores de confianza en tu proyecto; todos ellos, y nuestros proveedores de servicios, están sujetos a la misma confidencialidad. 13Garantías y responsabilidad

Nos comprometemos a entregar trabajo de calidad profesional acorde al brief aprobado. No garantizamos ningún resultado concreto en las redes sociales (visualizaciones, alcance, seguidores, ventas), ya que depende de factores fuera de nuestro control.

En la medida en que lo permita la ley, nuestra responsabilidad total por cualquier reclamo relacionado con un proyecto se limita al importe que pagaste por ese proyecto. No respondemos por daños indirectos, lucro cesante o pérdida de datos, ni por problemas causados por material que nos proporcionaste, por plataformas de terceros o por hechos fuera de nuestro control razonable.

14Cambios en estos términos

Podemos actualizar estos términos de vez en cuando. La versión publicada en esta página en el momento en que confirmas un proyecto es la que se aplica a ese proyecto. Los cambios importantes se comunicarán a los clientes activos a través de la plataforma o por email.

Diese Bedingungen gelten für alle Leistungen rund um Videoschnitt, Content-Strategie und verwandte Dienste von Voxen Visuals („Voxen“, „wir“, „uns“). Du („der Kunde“, „du“) akzeptierst sie, sobald wir eine Zusammenarbeit vereinbaren: durch die Annahme eines Angebots, die Bestätigung einer Bestellung oder die vereinbarte Zahlung. Bitte lies sie vor diesem Zeitpunkt.

01Leistungen

Voxen ist ein Content- und Marketingstudio. Je nach Auftrag umfassen unsere Leistungen Content-Strategie und -Planung, Skripte, Filmproduktion, Videoschnitt (Kurz- und Langformat: Reels, Shorts, VSL, Podcasts, YouTube, Vlogs, Talking Head, Gaming und KI-gestützte Stücke), Motion Graphics, Community Management, bezahlte Werbung, Veröffentlichung und Performance-Reporting über unsere eigene Plattform sowie jede Kombination davon als ganzheitlichen Marketingservice.

Der genaue Umfang jedes Projekts (Formate, Anzahl der Stücke, Länge, Stil, Fristen und Preis) wird im Angebot oder in der Bestellung festgelegt, die du annimmst. Was nicht im Angebot steht, ist nicht enthalten. Quell- oder Projektdateien (z. B. Projekte aus Premiere Pro, After Effects, DaVinci Resolve oder anderer Schnittsoftware) sind nicht Teil einer Lieferung, sofern das Angebot nichts anderes vorsieht.

02Angebote, Bestellungen und Pakete

Jedes Projekt beginnt mit einem Angebot, das Umfang, Zeitplan, Preis und Zahlungsplan festlegt. Das Projekt ist bestätigt, sobald du das Angebot annimmst und die vereinbarte Zahlung leistest.

Gültigkeit und Verfall. Angebote und ihre Preise gelten 15 Tage. Nach Annahme eines Angebots muss die vereinbarte Zahlung innerhalb von 7 Tagen eingehen; danach verfällt das Angebot und ein neues kann zu den aktuellen Preisen erstellt werden. Nach der Zahlung muss das Projekt innerhalb von 30 Tagen starten (Material und Briefing eingegangen); andernfalls wird es je nach unserer Verfügbarkeit neu terminiert. Bezahlte Bestellungen oder Paketstücke, die nicht innerhalb von 90 Tagen nach der Zahlung genutzt wurden, verfallen und werden nicht erstattet.

Pakete und Monatspläne. Paket- und Monatspreise liegen unter dem Preis einzelner Stücke, weil sie als Gesamtpaket verkauft werden. Deshalb gilt ein Paket als begonnen, sobald die Arbeit am ersten Video startet, und ab diesem Zeitpunkt unterliegt das gesamte Paket den Stornierungsregeln in Abschnitt 06.

03Zahlung

Preise, Währung und Zahlungsmethoden stehen im jeweiligen Angebot. Je nach Projekt kann die Zahlung erfolgen als:

• Vollständige Vorauszahlung, bevor die Arbeit beginnt.
• 50 / 50: eine Anzahlung vor Beginn und der Restbetrag bei Abschluss. Bei diesem Plan wird die erste Hälfte der Stücke nach der Anzahlung produziert, der Rest nach Eingang des Restbetrags.
• Nach Lieferung, nur wenn dies ausdrücklich im Angebot vereinbart ist.

Die Preise enthalten keine Steuern, Zölle oder Quellensteuern, die in deinem Land anfallen können; diese trägst du. Für jede Bestellung wird eine Rechnung oder Quittung ausgestellt. Bank-, Plattform- oder Währungsumrechnungsgebühren trägt der Kunde.

04Dein Material und deine Pflichten

Du bist für das Material verantwortlich, das du uns schickst (Aufnahmen, Audio, Bilder, Musik, Logos, Schriften, Skripte und alle anderen Assets). Mit dem Hochladen bestätigst du, dass:

• es dir gehört oder du die nötigen Rechte und Lizenzen hast, damit wir es bearbeiten und du das Ergebnis veröffentlichen kannst, einschließlich Musik, Stock-Material und Inhalten Dritter.
• alle Personen, die im Material erscheinen, die erforderliche Einwilligung zur Nutzung gegeben haben.
• es keine Gesetze oder Rechte Dritter verletzt und keine illegalen Inhalte enthält.

Du bist außerdem dafür verantwortlich, das Material in der vereinbarten Qualität zu liefern und Briefings, Feedback und Freigaben in angemessener Zeit zu geben. Verzögerungen auf deiner Seite verschieben den Liefertermin entsprechend.

Sollte ein Dritter behaupten, dass von dir bereitgestelltes Material seine Rechte verletzt, stellst du Voxen von diesem Anspruch frei.

05Lieferung und Korrekturen

Die übliche Bearbeitungszeit liegt in der Regel bei 2 bis 4 Werktagen pro Stück, je nach Projekt. Der konkrete Termin wird vor Beginn vereinbart und für jedes Stück in deinem Kundenportal angezeigt. Fristen laufen ab dem Zeitpunkt, an dem uns alles nötige Material und alle Informationen vorliegen. Lieferungen, die schneller als die vereinbarte Bearbeitungszeit gewünscht werden, werden separat als Eilauftrag angeboten und hängen von unserer Verfügbarkeit ab.

Korrekturen. Korrekturen sind unbegrenzt und werden in zwei Runden pro Stück organisiert: Du sammelst alle Änderungen einer Runde und schickst sie gebündelt über die Plattform (Kommentare können auf die exakte Sekunde des Videos gesetzt werden). Wir passen weiter an, bis du im Rahmen des ursprünglichen Briefings zufrieden bist. Änderungen, die den Umfang verändern (neues Material, ein anderes Konzept, ein längeres Stück, zusätzliche Formate), werden separat angeboten.

Ein Stück gilt als freigegeben, wenn du es in der Plattform freigibst oder wenn 14 Tage nach einer Lieferung oder Korrektur ohne Feedback von dir vergehen.

06Stornierungen und Rückerstattungen

Da unsere Arbeit beginnt, sobald eine Bestellung bestätigt ist, sind Zahlungen nach Arbeitsbeginn nicht erstattungsfähig. Das gilt auch für Anzahlungen.

Bei Paketen und Monatsplänen gilt das gesamte Paket als begonnen, sobald die Arbeit am ersten Video startet; für die verbleibenden Stücke gibt es keine Rückerstattung. Wenn du lieber aufhören möchtest, bleiben die bereits gelieferten Stücke bei dir und die restlichen können nach Absprache zu einem späteren Zeitpunkt eingeplant werden.

Können wir ein Projekt aus Gründen, die wir zu vertreten haben, nicht liefern, erstatten wir den Teil der Zahlung, der auf die nicht gelieferte Arbeit entfällt.

07Zahlungsverzug

Geht eine fällige Zahlung nicht ein, können wir finale Lieferungen zurückhalten sowie das Projekt und die Veröffentlichungsleistungen pausieren, bis der offene Betrag beglichen ist. Die Arbeit wird nach Zahlungseingang mit entsprechend angepassten Fristen fortgesetzt. Gelieferte Vorschauen sowie Versionen mit Wasserzeichen oder in niedriger Auflösung dürfen nicht veröffentlicht werden, bis der Restbetrag bezahlt ist.

08Geistiges Eigentum

Deine Inhalte. Du behältst alle Rechte an dem Material, das du uns bereitstellst.

Finale Videos. Sobald ein Projekt vollständig bezahlt ist, gehören die gelieferten finalen Videos dir und du kannst sie ohne Einschränkung auf jeder Plattform nutzen. Bis zur vollständigen Zahlung bleiben sie Eigentum von Voxen.

Portfolio. Wir dürfen die Videos, die wir für dich produzieren, auf unserer Website, in sozialen Medien und in Präsentationen als Arbeitsbeispiele zeigen, es sei denn, du teilst uns schriftlich mit, dass du das nicht möchtest, oder ein Vertrag bzw. eine Vertraulichkeitsvereinbarung zwischen uns sieht etwas anderes vor. Unveröffentlichtes Material teilen wir nie, bevor du es veröffentlichst. Wir dürfen dich außerdem als Kunden nennen (dein Name, deine Marke, dein Logo oder dein öffentlicher Social-Media-Handle) und dein Feedback auf unserer Website und in unseren Präsentationen zitieren, sofern du uns nicht schriftlich mitteilst, dass du das nicht möchtest.

Unsere Tools und unser Know-how. Unsere Workflows, Vorlagen, Presets, unsere Plattform und internen Methoden bleiben unser Eigentum. Assets Dritter (Musik, Stock-Material, Schriften, Plug-ins) unterliegen ihren eigenen Lizenzen, über die wir dich informieren, wenn es relevant ist.

09Aufbewahrung von Dateien

Rohmaterial, Arbeitsdateien und Lieferungen werden auf unserer Plattform 14 Tage nach jeder Lieferung aufbewahrt. Mit jeder gesendeten Korrektur beginnt die 14-Tage-Frist neu. Danach können die Dateien gelöscht werden, lade deine finalen Videos also herunter, sobald du sie freigibst. Wenn wir Dateien länger aufbewahren sollen, sag uns vor Ablauf der Frist Bescheid.

10Kundenplattform und Konten

Wir geben dir Zugang zu unserer Kundenplattform, damit du den Status jedes Stücks verfolgen, Kommentare auf die exakte Sekunde eines Videos setzen, Lieferungen freigeben, Dateien herunterladen, deine Bestellungen, Angebote, Zahlungen und Rechnungen verwalten, deine Markenrichtlinien hinterlegen, deinen Content-Kalender nutzen und, falls beauftragt, Veröffentlichung und Kennzahlen deiner verbundenen Social-Media-Konten verwalten kannst. Konten werden von uns erstellt und sind persönlich: Bewahre deine Zugangsdaten sicher auf, gib sie nicht weiter und informiere uns, wenn du einen unbefugten Zugriff vermutest. Du kannst dich mit Google oder mit E-Mail und Passwort anmelden und die Zwei-Faktor-Authentifizierung aktivieren. Deine Anmeldedaten sind privat und werden nur verwendet, um dir Zugang zu geben.

Du verpflichtest dich, die Plattform nur für unsere gemeinsamen Projekte zu nutzen und nicht zu versuchen, auf Daten anderer Kunden zuzugreifen, den Dienst zu stören oder schädliche Inhalte hochzuladen. Bei Missbrauch können wir den Zugang sperren.

Die Plattform wird „wie besehen“ bereitgestellt. Wir bemühen uns, sie verfügbar zu halten, garantieren aber keinen unterbrechungsfreien Zugang; sie ersetzt nicht deine eigenen Sicherungskopien deiner Inhalte.

11Einsatz von KI-Tools

Wir setzen in Teilen unseres Prozesses Werkzeuge der künstlichen Intelligenz ein, zum Beispiel um Briefings zu analysieren, Texte zu entwerfen, Audio zu transkribieren, Schnitte vorzuschlagen oder visuelle Elemente zu erzeugen. Jedes Stück wird vor der Lieferung von unserem Team geprüft und fertiggestellt. Wenn ein Projekt erfordert, dass keine KI-generierten Elemente verwendet werden, sag es uns im Briefing und wir arbeiten entsprechend. KI-generierte Inhalte werden zu denselben Bedingungen geliefert wie der Rest der Arbeit, vorbehaltlich der Grenzen der eingesetzten Tools und des geltenden Rechts.

12Vertraulichkeit

Wir behandeln dein unveröffentlichtes Material, Briefings, Geschäftsinformationen und Zugangsdaten vertraulich und nutzen sie nur zur Erbringung der Leistung. Wir können Mitglieder unseres Teams und vertrauenswürdige Partner in dein Projekt einbeziehen; sie alle sowie unsere Dienstleister sind an dieselbe Vertraulichkeit gebunden. Wie wir mit personenbezogenen Daten umgehen, steht in unserer Datenschutzerklärung.

13Gewährleistung und Haftung

Wir verpflichten uns, Arbeit in professioneller Qualität zu liefern, die dem freigegebenen Briefing entspricht. Wir garantieren keine bestimmten Ergebnisse auf Social-Media-Plattformen (Aufrufe, Reichweite, Follower, Verkäufe), da diese von Faktoren außerhalb unserer Kontrolle abhängen.

Soweit gesetzlich zulässig, ist unsere Gesamthaftung für jeden Anspruch im Zusammenhang mit einem Projekt auf den Betrag begrenzt, den du für dieses Projekt bezahlt hast. Wir haften nicht für indirekte Schäden, entgangenen Gewinn oder Datenverlust, noch für Probleme, die durch von dir bereitgestelltes Material, Plattformen Dritter oder Ereignisse außerhalb unserer angemessenen Kontrolle verursacht werden.

14Änderungen dieser Bedingungen

Wir können diese Bedingungen von Zeit zu Zeit aktualisieren. Für ein Projekt gilt die Version, die zum Zeitpunkt deiner Projektbestätigung auf dieser Seite veröffentlicht ist. Wesentliche Änderungen teilen wir aktiven Kunden über die Plattform oder per E-Mail mit.
